The Litmus Test
"It is blindingly clear that judges have no greater aptitude than the average person to determine moral issues."
If the Supreme Court nominee agrees with this qoute from Scalia, then he/she has got my support!

I don't generally agree with Scalia, but nobody (or very few people, and most of those people belong to the religious right) believe that the Supreme Court should decide moral issues.
The Court (along with the president and Congress) is there to decide LEGAL issues. I think the entire government needs to recognize that distinction.

I'm gonna guess that you are being sarcastic.
The religous right wants the court to decide moral issues?
No the religous right uses the legislature to push moral issues. It's the left that uses the courts to overturn the laws passed. I.e. abortion, anti-sodomy laws, capital punishment, the list goes on and on...

So Dubya is gonna put a Conservative on the Court just to sit there and look pretty?
He's gonna put a Conservative there to uphold the laws that dictate morality. And legislating morality is just as bad as ddetermining morality through the courts and it's something that American democracy should not be fond of.
